<p dir="rtl">These Regulations shall be cited as the Natural Reserves and National Parks Regulations of 2005, and shall be effective as of the date of their publication in the Official Gazette.</p>

<p dir="ltr">A. The following terms and expressions wherever appearing herein, shall have the meanings assigned to them hereunder unless the context provides otherwise: <br /> </p>

<p dir="rtl">B. The definitions of the terms appearing in the Environmental Protection Law in force shall apply herein.</p>

<p align="left">Article 3</p>
<p align="left"></p>
</div>

<p dir="rtl">A. The Specialized Entity shall submit an application to the Ministry requesting the establishment or management of a Natural Reserve or National Park, and shall attach thereto a study that includes the following: <br /><br />1. The purpose of the establishment of the Natural Reserve or National Park. <br />2. The area and boundaries of the Natural Reserve or National Park. <br />3. The rights of the citizens in and around the Natural Reserve or National Park. <br />4. A site plan for the location showing the titles and uses of the lands surrounding the Natural Reserve or National Park. <br />5. A preliminary study of the flora and fauna and the ecosystem of the Natural Reserve or National Park. <br />6. A preliminary geological and hydrological study of the archaeological sites therein, if any. <br />7. A preliminary geological and hydrological study of the site. <br />8. An identification of the effects of establishing the Natural Reserve or National Park on the surrounding lands. <br />9. An economic and social study of the region of the Natural Reserve or National Park. <br />10. Protection measures and the manner of exercise and specifications thereof. <br />11. Any other data or studies requested by the Minister if the nature of the area so requires. <br /><br />B. A technical committee shall be formed by decision of the Minister that will review the application related to the establishment and management of a Natural Reserve or National Park, and it shall present its recommendations to the Minister to take the appropriate decision in its regard.</p>

<p dir="rtl">The boundaries of a Natural Reserve or National Park shall be amended by decision of the Council of Ministers upon the recommendation of the Minister on the basis of the recommendation of the technical committee referred to in Paragraph B of Article 3 hereof, in accordance with the study submitted by the Specialized Entity to the Ministry.</p>

<p dir="rtl">A. The Specialized Entity shall set a detailed management plan for the Natural Reserve or National Park within a period not exceeding one and one-half years from the date that the Natural Reserve or National Park is so designated by the Council of Ministers. The plan shall be submitted to the Ministry to issue the appropriate decision in its regard within a period not exceeding 3 months. In the event that the management plan is approved, the Specialized Entity shall become responsible for the implementation thereof. <br /><br />B. The management plan submitted to the Ministry must include the following:<br /> <br />1. A detailed description of the location of the Natural Reserve or National Park. <br />2. An assessment of the components of the Natural Reserve or National Park. <br />3. Setting the objectives of the location’s management and the implementation procedures therefor. <br />4. Preparing the estimated budget for the management plan and sources of funding available. <br />5. Land use within and surrounding the Natural Reserve or National Park. <br />6. Regulating grazing. <br />7. Regulating environmental tourism. <br />8. Rules for the use of the Natural Reserve or National Park and local community participation.</p>

<p dir="rtl">The Ministry, in coordination with the parties concerned, shall recommend to any relevant party to purchase, lease or appropriate the lands owned within the borders of the Natural Reserve or National Park. Otherwise the owners of these lands shall have the right to use their lands in a manner not in conflict with the protection objectives and the management plan of the Natural Reserve or National Park.</p>

<p dir="rtl">Issues concerning service revenue received from the Natural Reserves or National Parks and the relevant procedures and methods for keeping and spending such revenue shall be set in accordance with instructions issued by the Minister.</p>

<p align="left">Article 8</p>
<p align="left"></p>
</div>

<p dir="rtl">Subject to the provisions of any other legislation, the Minister may designate any location as a sanctuary for rare flora or fauna, or a place whose nature is beautiful, irrespective of its area, and designate it as an Area of Special Protection, provided that matters related to its protection and management shall regulated by instructions issued by the Minister for that purpose.</p>

<p dir="rtl">Subject to the provisions of any other legislation, no person is permitted to carry out any activities within the boundaries of the Natural Reserve or National Park including the exploitation of the natural resources thereof, without the approval of the Specialized Entity managing the Natural Reserve or National Park, and in accordance with bases and conditions set pursuant to instructions issued by the Minister for this purpose.</p>

<p dir="rtl">The Minister shall issue the instructions necessary for the implementation of the provisions of these Regulations including the bases and conditions for the establishment, management, monitoring and all relevant aspects of Natural Reserves and National Parks.</p>

<p><span style="font-family: Calibri; font-size: medium;" face="Calibri" size="3">The Ministry adopted two bylaws which are directly related to biodiversity namely the Bylaw on Protected Areas and National Parks (Number 29 for the year 2005), and the Bylaw on Environmental Impact Assessment (Number 37 for the year 2005). </span></p>
<p><span style="font-family: Calibri; font-size: medium;" face="Calibri" size="3">It is important to note that the Ministry is currently working on amending of its general law. The new amended law is foreseen to enhance the legal framework on biodiversity, as it will include the development and adoption of several bylaws, specifically on protected areas, genetic resources and biodiversity, and species conservation. The law will also include the revision of the EIA Bylaw, introducing improved legal tools and mechanisms on biodiversity safeguards and management. RSCN is mandated by the Ministry of Environment to implement the Bylaw on Protected Areas and National Parks in what is considered a unique model for the region and globally, whereas an NGO is mandated to implement government mandates. This is attributed to the long established experience of RSCN as a pioneering nature conservation agency active in Jordan since the mid-1960s. Such an innovative governance arrangement could be applicable to other subsectors of biodiversity protection, hence will be a focus of the current strategy.</span></p>
<p><span style="font-family: Calibri; font-size: medium;" face="Calibri" size="3">The second main legal framework for biodiversity is represented by the law of the Ministry of Agriculture, the long established legal provisions of the Ministry of Agriculture which owns the historical precedence in the protection of wildlife, forests, and rangelands, as well as genetic resources. This mandate is currently mandated by the application of the Agriculture Law (Number 44 of the year 2002), which includes a series of articles addressing the sustainable use of natural resources, including genetic diversity and the protection of wildlife species inside and outside their natural habitats. RSCN is also mandated by the Ministry of Agriculture to enforce the regulations related to wildlife protection and hunting control. The Ministry has recently been developing its technical capacities in relation to biodiversity protection in an increasing trend of recognition of the modern approaches tackling ecosystem management and biodiversity conservation. The two strategic roles of the two line ministries often overlap and a concerted effort is required to ensure synergy, complementarity, and coordination. This strategy briefly addresses the need to enhance inter-ministerial dialogue and coordination towards a more effective program on biodiversity.</span></p>
<p><span style="font-family: Calibri; font-size: medium;" face="Calibri" size="3">The third legal framework is represented by the special setup associated with the Aqaba Economic Zone Authority and its sub-national mandate over environmental protection and management. ASEZA was established in 2000 and enjoys a special law (Number 32 for the year 2000) which entitles the Authority to implement its autonomous legal systems and regulations, including provisions related to environmental protection and biodiversity conservation. ASEZA enjoys its own set of bylaws addressing environmental protection, environmental impact assessment, as well as the special bylaw addressing the Wadi Rum Protected Area. The ASEZA case, although representing a success story in applying a decentralized approach towards environmental protection, entails a number of strategic and operational challenges related to the alignment of its regional legal arrangements with the national setting. Further, the auton omous setup is often constrained by the potential for conflicts of interest in balancing the development agendas with the conservation obligation. This strategy calls for the initiation of a strategic dialogue between ASEZA and the Ministry of Environment on the national alignment of ASEZA’s environmental legislations and the facilitation of knowledge exchange, reciprocal support and collaboration.</span></p>

<td class="text"><span style="font-size: medium;" size="3"><span style="font-size: medium;" size="3"> The conventions and legislation for environmental protection are playing a major role in protecting species at risk. 18 acts and 8 regulations were issued in Jordan, including provisions for the protection of the environment. Most of these acts are being implemented through different government agencies.</span></span>
<p>The recently established Environmental Police Department and a unit in the Ministry of Environment set up to enforce environmental laws and regulations. Jordan has also started using unleaded fuel during 2008 to reduce air pollution. Moreover, the ministry has intensified inspection campaigns on industrial facilities to check on their abidance by environmental regulations and has also introduced new techniques to treat medical and solid waste.</p>

<p>The conventions and legislation for environmental protection are playing a major role in protecting species at risk. Eighteen acts and eight regulations were issued in Jordan, including provisions for the protection of the environment.</p>

<p>27 Important Bird Areas (IBAs) have been identified, significant portions of which are protected since these portions are located in established protected areas, many (un protected) IBAs are located in proposed protected areas and expected to be protected in the future, and few are not expected to be protected as protected areas at least in the short and medium runs. Also, 13 Important wetlands are identifies according to the Directory of Wetlands including one Ramsar Site: Azraq wetland.</p>

<p>The Convention on Wetlands which was convened in 1971 in Ramsar, Iran–known as the "Ramsar Convention" is an intergovernmental treaty that embodies the commitments of its member countries to maintain the ecological character of their Wetlands of International Importance and to plan for the "wise use", or sustainable use, of all of the wetlands in their territories.</p>
<p>The Convention on Wetlands came into force for Jordan on 10 May 1977. Jordan presently has one site designated as a Wetland of International Importance, with a surface area of 7,372 hectares. Jordan Ramsar site is the Azraq Oasis and Qa’a, inscribed on the list in July 1990. Azraq is formerly a permanent, spring-fed wetland and extensive (6,127ha) seasonally-flooded mudflat of a large drainage basin. Under natural conditions, the lush oasis supported reed and sedge communities restricted to Azraq Oasis. It is a valuable staging area for migrating birds and serves as an important water supply for local communities, as well as one of the main water sources for the capital city, Amman. Azraq suffers from unsustainable groundwater extraction which led to the almost complete desiccation of the site.</p>
<p>This site has been almost totally destroyed except from very limited part which is manually fed by water to maintain this ecosystem. This destruction was resulted from severe water abstraction that exceeds many fold of its annual recharge. Accordingly, within the last twenty years, at least 50% of the plant biodiversity recorded in 1995 survey has been lost. Among these lost species are very rare and endemic species that do not occur anywhere else in Jordan. A rehabilitation program has been implemented for Azraq since mid-1990s including the establishment of the Azraq Wetland Reserve (around 10% of the Ramsar site) by RSCN in cooperation with the MoEnv, MoWI and international donor agencies such as GEF, World Bank and GIZ</p>

<td class="text"><span style="font-size: medium;" size="3"><span style="font-size: medium;" size="3"> Jordan has limited forest resources with less than 1.5% of the country being classified as forests. Of this forest land, only 26% have forest cover with a canopy density of 10% or more and the rest is mostly composed of land sparsely covered with vegetation. The forests in Jordan, especially natural forests, are fragmented, open in density, slow growing, of degraded conditions and, thus, of low commercial value. Commercial forests are only expected in areas receiving more than 400 mm of precipitation annually. Such lands constitute only 9% of the total forestlands. Afforestation activities can be implemented in areas receiving more than 250 mm/year which constitute 8.3% of the total forestland.</span></span>
<p>The forest vegetation in Jordan can be divided into the following categories:</p>
<span style="font-size: medium;" size="3"><span style="font-size: medium;" size="3"></span></span>
<p>• Natural forests that are composed of evergreen shrubs, pine and juniper forest as well as broadleaf forests. Artificial or man-made forests, areas are afforested artificially by the Forestry Department since the 1950s.</p>
<span style="font-size: medium;" size="3"><span style="font-size: medium;" size="3"></span></span>
<p>• The afforested areas are found in all registered forest land in Jordan. They are planted mostly with Pinus halepensis and Acacia saligna. The survival rate varies from 0 to 75 %.</p>
<span style="font-size: medium;" size="3"><span style="font-size: medium;" size="3"></span></span>
<p>• Bare forest lands, areas registered as forest land in the name of the government treasury but being presently bare of forest cover. They are characterized by rough topography, poor site conditions, soil erosion hazards, over grazing or over harvesting.</p>
<span style="font-size: medium;" size="3"><span style="font-size: medium;" size="3"></span></span>
<p>• Unsettled forest areas, areas covered completely or partially by forest trees, but still un-surveyed or unregistered. The total area of unregistered forest area is estimated at 12,200 ha. These areas are in principle governmental land at the disposition of the forestry administration.</p>
<span style="font-size: medium;" size="3"><span style="font-size: medium;" size="3"></span></span>
<p>• Roadside plantations cover about 2,500 km of roadsides. Trees planted along the roads belong to the government and are managed by the Forestry Department. All these are government forests either registered in the name of the Jordan Government Treasury as forestland or declared as forestland according to the 1973 Agricultural Law no. 20 and to the 1974 Government property owned management Law no. 17.</p>

<p>Private forests are registered in the name of their private owners and are found mostly in the northern part of Jordan where higher rainfall is prevailing. They include natural forest vegetation and tree plantations on farms, in the form of windbreaks and shelter-belts. Private forests account for less than 4 % of the total declared forestland.</p>
